You are bound by these Terms of Service and the current My Radio Privacy Policy published on the My Radio app when using the services provided by the My Radio app on your mobile device and viewing the content available on the My Radio app. By agreeing to these terms of service, you agree to my Radio collecting, using, and disclosing your data, including your personally identifiable information ("PII"), in relation to your use of my Radio services (as described in our privacy policy). These terms of service govern the access and use of my Radioa services and any content, information, products, or services by all users and content providers. This is a legal agreement between you and my Radio. If you do not fully accept these terms of service, you may not access, use, or link to your content on my Radio service. If you access and use my Radio services on behalf of a company or other legal entity, you represent that you have the right to bind that company or other legal entity to comply with these terms of service, and all references to "you" in these terms of service apply to that company or legal entity.
Important notice regarding unsubscribe: By agreeing to these Terms of Service, you agree to resolve any dissatisfaction or dispute regarding my Radio services through binding unsubscribe. Please carefully read Section 13 "Consumer Dispute Resolution" below for detailed information.
1. General provisions
Personal usage restrictions: My Radio service is for your personal, non-commercial use only. It is strictly prohibited to use My Radio for selling products or services, or to increase website traffic for commercial purposes such as advertising sales. Without the explicit permission of My Radio, it is not allowed to obtain and reformat search results, mirror the My Radio homepage or results page on your website, or send automatic queries to the My Radio system. Third party links: Third party links on My Radio services displayed as search results or websites owned and operated by individuals (including online streaming audio and/or television stations) are beyond My Radio's control. If the owner and operator of the linked website wish to delete links from My Radio, they must contact My Radio and explicitly request deletion.
2. Content
Some types of content can be obtained through the My Radio service. The term 'My Radio content' used in these Terms of Service refers to text, audio, data, graphics, images, photos, and video files provided through the My Radio service, but does not include content submitted by users. The content submitted by users refers to the text, audio, data, graphics, images, photos, and other content and information posted, uploaded, and otherwise submitted to the My Radio service by My Radio members, including but not limited to personal profile pages created by members. User submitted content also includes recordings, music works, etc. from any online streaming television or radio stations linked through the My Radio service. MY RADIO reserves the right to remove and permanently delete any MY RADIO content or user submitted content from MY RADIO services without notice or liability to you.
3. Content ownership, responsibility, and deletion.
a. Ownership of User Submitted Content: My Radio does not claim any ownership of any User Submitted Content, and nothing in these Terms of Service shall be deemed to limit your right to use and exploit User Submitted Content. In addition to the above provisions, My Radio and its licensors exclusively own all rights, ownership, and interests in My Radio services and My Radio content, including all related intellectual property rights.
b. Trademark License: If you are a radio or television broadcasting entity and your radio is linked through the My Radio service, you hereby grant My Radio and its licensees a non exclusive, transferable, global, royalty free, and sublicensable license to use, copy, modify, resize, distribute, publicly display, and perform the logos and trademarks and/or service marks (collectively, "Trademarks") provided to My Radio through the My Radio service for the purpose of promoting, marketing, and advertising your radio or television station on any media currently known or designed in the future, as well as providing your radio station through the My Radio service or website. According to the above license, you reserve all rights, ownership, and interests in your trademark and all intellectual property contained therein.
c. Responsibility for User Submitted Content: You are fully responsible for all user submitted content. You declare and warrant that you own all user submitted content, or that you have all the necessary rights to grant us user submitted content licenses under these Terms of Service. You also declare and warrant that your user submitted content, your use and provision of user submitted content provided through the My Radio service, and any use of your user submitted content by My Radio on or through the My Radio service will not infringe, misappropriate, or violate any third-party intellectual property rights, disclosure rights, or privacy rights, or result in a violation of any applicable laws or regulations.
d. Delete content submitted by users: You can specifically delete content submitted by your users. However, in some cases, the content submitted by some of your users (such as posts or comments you post) may not be completely deleted, and copies of your user content may continue to exist in the My Radio service. We are not responsible for the deletion or removal (or failure to delete or remove) of any content submitted by your users.
4. Rights and terms of My Radio Apps.
a. The rights to My Radio Apps granted by My Radio. Subject to your compliance with these Terms of Service, My Radio grants you a limited, non exclusive, non transferable license, without the right to sublicense, to download and install copies of My Radio Apps on mobile devices or computers owned or controlled by you, and to operate such copies of My Radio Apps solely for your personal non-commercial purposes. You are not allowed to copy My Radio Apps, except for making a reasonable number of copies for backup or archiving purposes. Unless expressly permitted by these Terms of Service, you may not: (i) copy, modify, or create derivative works based on My Radio Apps; (ii) Distribute, transfer, sublicense, rent, lend or lease My Radio Apps to any third party; (iii) Reverse engineer, decompile, or disassemble My Radio Apps; Or (iv) provide the functionality of My Radio Apps to multiple users through any means. My Radio reserves all rights to the My Radio application that are not explicitly granted to you in these Terms of Service.
b. Access the My Radio application from the App Store. The following terms apply to any My Radio application accessed or downloaded through any app store or distribution platform (such as the Apple App Store or Google Play), which may now or in the future provide the My Radio application (each a "Application Provider"). You acknowledge and agree that:
These terms of service are signed between you and My Radio, not with the application provider, and My Radio (not the application provider) is fully responsible for the My Radio application.
The application provider is not obligated to provide any maintenance and support services related to the My Radio application.
If the My Radio application does not comply with any applicable warranties, you may notify the application provider, who will refund you the purchase price of the My Radio application (if applicable), and to the maximum extent permitted by applicable law, the application provider shall not assume any other warranty obligations for the My Radio application. Any other claims, losses, liabilities, damages, costs or expenses arising from non-compliance with any warranties shall be solely borne by My Radio.
The application provider is not responsible for handling any claims you make or any third-party claims related to the My Radio application or your ownership and use of the My Radio application, including but not limited to: (i) product liability claims; (ii) Any claim that the My Radio application does not comply with any applicable laws or regulatory requirements; And (iii) claims made under consumer protection or similar legislation.
If any third party claims that the My Radio application or your ownership and use of the My Radio application infringes upon the intellectual property rights of such third party, My Radio will be fully responsible for investigating, defending, resolving, and releasing any such intellectual property infringement claims within the scope required by these Terms of Service.
The application provider and its subsidiaries are third-party beneficiaries of these terms of service related to your license to the My Radio application, and upon your acceptance of the terms of service, the application provider will have the right (and will be deemed to have accepted that right) to act as a third-party beneficiary to enforce these terms of service related to your license to the My Radio application against you.
You declare and warrant that: (i) your country is not a target country of US government sanctions, nor is it designated by the US government as a country that supports terrorism; (ii) You have not been listed as a prohibited or restricted party by any US government.
When using the My Radio application, you must also comply with all applicable third-party service terms.
5. Feedback
We welcome feedback, comments, and suggestions on the improvement of My Radio services ("Feedback"). You can do it through qinyuan1210@gamil.com Send an email to My Radio to submit feedback. You grant My Radio a non exclusive, transferable, global, perpetual, irrevocable, fully paid, royalty free license, and the right to sublicense any and all intellectual property owned or controlled by you to use, copy, modify, create derivative works based on feedback, and otherwise utilize feedback for any purpose.
6. Paid function
Some features of My Radio service, such as removing in app ads, may require you to pay to use them. If you choose to purchase these features, it means that you explicitly authorize us or our payment processor to charge the corresponding fees through the payment method you provide. Unless otherwise specified, all fees are non refundable. All fees and applicable taxes (if any) shall be paid in US dollars.
When you purchase any additional features we provide, a one-time fee will be charged for the purchase. Once you purchase these features and use all or part of them, or cancel your account before using all features, you will not be entitled to a refund. According to Article 8 of these Terms of Service, we reserve the right to terminate or suspend your use of the paid features of My Radio service for any reason at any time, without assuming any responsibility. If we terminate or suspend your account in accordance with Article 8 of these Terms of Service, with or without reason, you will not be entitled to a refund of any fees paid to us for these features, unless otherwise provided in the Terms of Sale.
7. Your obligations when using My Radio services.
My Radio service can only be used for legal and non-commercial purposes. You agree to comply with all applicable local, state, national, and foreign laws, treaties, and regulations, including laws applicable to your business and operations, as well as privacy, security, and PII cross-border transfers related to your use of My Radio services (including but not limited to compliance with the General Data Protection Law (EU 2016/679) ("GDPR")). If necessary, you shall be responsible for collecting and collecting, using, maintaining, and sharing any verifiable consent related to PII with My Radio (as defined by GDPR), and have any and all rights necessary to provide such data to My Radio, and ensure the correct acquisition of any such data.
In addition, without limitation, you agree not to perform any of the following actions when using or accessing the website or My Radio application:

b. Upload, publish, send via email or otherwise transmit (i) any user submitted content that you have no legal right to copy, transmit and display (including any user submitted content that violates your confidentiality or trust obligations towards user submitted content); (ii) You have not obtained the consent or permission of each identifiable person in the user submitted content, and are unable to use their name, voice, signature, photo, or portrait (as long as they are related to the user submitted content), and such consent or permission is required; Or (iii) any user submitted content that infringes intellectual property rights or any third-party privacy rights (including but not limited to copyright, trademark, patent, trade secret or other intellectual property rights, or moral rights or disclosure rights);
c. Use any meta tags or other hidden text or metadata that utilizes the My Radio name, trademark, URL, or product name;
d. Upload, publish, send via email or otherwise transmit any unsolicited or unauthorized advertisements, promotional materials, spam emails, junk messages, chain letters, pyramid schemes or any other form of solicitation;
e. Falsify any TCP/IP packet header or any part of the header information in any post, or use the My Radio service in any way to send altered, deceptive, or false source identification information;
f. Upload, publish, email or otherwise transmit any user submitted content that is illegal, obscene, harmful, threatening, harassing, defamatory or hateful through the My Radio service, or contains hate objects or symbols, violates any third-party privacy, contains nudity (including but not limited to any pornography, eroticism, child pornography or child pornography), deceives, threats, insults, incites illegal behavior, defames, slanders, vulgar or violent, or constitutes hate speech or other user submitted content that My Radio deems offensive;
g. Upload, publish, send via email, or otherwise transmit any user submitted content that contains hidden code or is secretly included in any image, audio, or video of the user submitted content, and such code is unrelated to the directness or aesthetics of the user submitted content;
h. Interfere with or disrupt (or attempt to interfere with or disrupt) any webpage on My Radio services, servers, or networks connected to My Radio services, or on the technical delivery systems of My Radio providers, or violate any requirements, procedures, policies, or regulations of networks connected to My Radio services;
i. Attempting to detect, scan, or test any vulnerabilities in My Radio systems or networks, or to disrupt, impair, or circumvent any security or authentication measures that protect My Radio services;
j. Attempting to decipher, decompile, disassemble, or reverse engineer any software used to provide My Radio services;
k. Attempt to use any engine, software, tool, agent, device, or mechanism other than software and/or search agents provided by My Radio or other commonly available third-party web browsers (such as Microsoft Internet Explorer, Mozilla Firefox, Safari, or Opera) to access, search, or meta search My Radio services, including but not limited to any software that sends queries to websites to determine how websites or web pages rank.
l. Collecting or storing personal data related to other My Radio users without explicit permission from them;
m. Impersonate or distort your relationship with any individual or entity through excuses or other forms of social engineering, or commit fraud in other ways;
n. Using My Radio services in any way not permitted by this agreement;
o. Encourage or instruct any other individual to do any of the above actions or violate any terms of these Terms of Service.
8. Termination; Cancel.
a. If you violate these terms of service, we may immediately terminate or suspend your access to the My Radio service and delete any materials (including user submitted content) from the My Radio service or our servers. Despite the above provisions, we reserve the right to terminate the My Radio service or your access to the service at any time for any reason. After termination, you understand and acknowledge that we are no longer obligated to provide My Radio services. After termination, all licenses and other rights granted to you by these Terms of Service will immediately terminate. My Radio shall not be liable to you or any third party for terminating the My Radio service or for terminating your use of the My Radio service. After termination or suspension, you will no longer be able to access any information you submit on the My Radio service or related to your account (including user submitted content). In addition, My Radio is not obligated to maintain any information related to your account in our database, nor is it obligated to forward any information to you or any third party.
b. Any suspension, termination, or cancellation shall not affect your obligations to My Radio under these Terms of Service (including but not limited to ownership, compensation, and liability limitations), the meaning and context of which are intended to continue in effect after the suspension, termination, or cancellation.
9. Modify My Radio services or terms of service.
My Radio reserves the right to modify, suspend, or terminate the My Radio service or modify these terms of service at any time without prior notice. If you do not accept any modified terms and conditions in the revised terms of service, your only remedy is to cease using the My Radio service. By continuing to access or use My Radio services after making any such modifications, you agree to be bound by the revised terms of service.
10. Disclaimer.
My Radio assumes no responsibility for the accuracy, content, completeness, legality, reliability, operability, or availability of information or materials displayed on My Radio services. My Radio is not responsible for any deletion, storage failure, incorrect delivery, or failure to deliver any information or materials in a timely manner. My Radio is not responsible for any damage caused by downloading or accessing any information or materials on the Internet through My Radio service.
MY RADIO services are provided "as is" without any warranty. MY RADIO expressly disclaims all express, implied, and statutory warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non infringement of proprietary rights, to the maximum extent permitted by law. MY RADIO denies any warranties regarding the security, reliability, timeliness, and performance of MY RADIO services. MY RADIO denies any warranty regarding any information or advice obtained through MY RADIO services. MY RADIO does not guarantee any services or goods received through MY RADIO services, promoted on MY RADIO services, or through any links provided by MY RADIO, as well as any information or advice received through any links provided in MY RADIO services.
You understand and agree that downloading or otherwise obtaining materials or data through the use of MY RADIO services is solely at your discretion and at your own risk, and you will be fully responsible for any damage to your computer system or loss of data resulting from downloading such materials or data.
Some states or other jurisdictions do not allow the exclusion of implied warranties, so the above exclusion clauses may not apply to you. You may also have other rights, but the specific rights vary by state and jurisdiction.
11. Limitation of Liability.
Under no circumstances shall MY RADIO be liable to any user for any claims related to this Agreement or its subject matter arising from the user's use, misuse, or reliance on MY RADIO services. Such liability limitations shall apply to prevent recovery of direct, indirect, incidental, consequential, special, punitive, and punitive damages, regardless of whether such claims are based on warranty, contract, tort (including negligence), or otherwise (even if MY RADIO has been informed of the possibility of such damages). Regardless of whether the damage is caused by the use, misuse, and reliance on MY RADIO services, inability to use MY RADIO services, or interruption, suspension, or termination of MY RADIO services (including damages caused by third parties), such liability limitations shall apply. In any event, all liabilities arising from or related to the use or inability to use MY RADIO services or content under these terms of service shall not exceed the amount paid by you to MY RADIO for the use of MY RADIO services or content.
Some states or other jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential damages, so the above limitations and exclusions may not apply to you.
Without limiting the foregoing provisions, under no circumstances will My Radio be liable for any delay or failure to perform its obligations directly or indirectly caused by natural disasters, forces or reasons beyond its reasonable control, including but not limited to Internet failures, computer equipment failures, telecommunications equipment failures, other equipment failures, power failures, strikes, labor disputes, riots, uprisings, civil unrest, labor or material shortages, fires, floods, storms, explosions, acts of God, wars, government acts, orders of domestic or foreign courts or courts, third-party failures, or losses or fluctuations in heating, lighting or air conditioning.
12. Applicable laws and selection of trial venue.
These terms and any related actions are governed by the Constitution of the People's Republic of China and the Civil Code of the People's Republic of China, without regard to their conflict of laws provisions.
13. Consumer dispute resolution.
The following terms in Article 13 "Consumer Dispute Resolution" only apply to situations where you are an individual and use My Radio services and My Radio content for personal purposes and do not represent a legal entity.
a. Resolution of disputes. We both agree that any disputes or cancellations of subscriptions (collectively, "Disputes") arising from or related to these Terms of Service or their breach, termination, execution, interpretation or validity, or the use of My Radio services or My Radio content, shall be resolved solely through binding individual communications and not through collective, representative or merger proceedings.
b. When users encounter the following issues while using My Radio, they can choose to unsubscribe: (i) the APP service has serious functional failures or cannot be used normally; (ii) The virtual goods or services purchased by Party B in the APP do not match the description, and Party B has not made any consumption or use; (iii) Within 72 hours after purchasing the APP service, if the user needs to cancel the service due to personal reasons and the service has not been activated or used; (iiii) Each user's refund amount for the same product or service shall not exceed the payment amount. Refund requests that exceed the limit will not be supported.
14. DMCA/Copyright Policy.
My Radio respects copyright law and hopes that our users will also respect copyright law. My Radio's policy is to terminate accounts of account holders who have repeatedly infringed or are deemed to have repeatedly infringed upon the rights of copyright holders in appropriate circumstances.
15. Other regulations.
The Chinese version of these Terms of Service governs your use of My Radio services. In the event of any conflict between the Chinese version and the translated version, the Chinese version shall prevail.
These Terms of Service constitute the entire agreement between the parties with respect to the subject matter of these Terms of Service and supersede and replace all prior or contemporaneous written or oral understandings or agreements with respect to such subject matter. Any waiver of any provision of the terms of service shall only be valid in writing and signed by My Radio.

应用程序提供商不负责处理您提出的任何索赔或任何第三方与 My Radio 应用程序或您拥有和使用 My Radio 应用程序有关的任何索赔，包括但不限于：（i）产品责任索赔；（ii）任何声称 My Radio 应用程序不符合任何适用法律或监管要求的索赔；以及（iii）根据消费者保护或类似立法提出的索赔。
如果任何第三方声称 My Radio 应用程序或您对 My Radio 应用程序的拥有和使用侵犯了该第三方的知识产权，则 My Radio 将在本服务条款要求的范围内全权负责调查、辩护、解决和解除任何此类知识产权侵权索赔。
应用程序提供商及其子公司是与您对 My Radio 应用程序的许可相关的本服务条款的第三方受益人，并且在您接受服务条款后，应用程序提供商将有权（并将被视为已接受该权利）作为第三方受益人对您执行与您对 My Radio 应用程序的许可相关的本服务条款。
您声明并保证：(i) 您所在的国家不属于美国政府禁运的对象国，也不属于被美国政府指定为支持恐怖主义的国家；(ii) 您未被列入任何美国政府的禁止或限制方名单。
使用 My Radio 应用程序时，您还必须遵守所有适用的第三方服务条款。
5.反馈
我们欢迎对 My Radio 服务改进的反馈、评论和建议（“反馈”）。您可以通过qinyuan1210@gamil.com向 My Radio 发送电子邮件提交反馈。您授予 My Radio 非排他性、可转让、全球性、永久性、不可撤销、全额付费、免版税的许可，并有权根据您拥有或控制的任何和所有知识产权进行再授权，以使用、复制、修改、基于反馈创作衍生作品并以其他方式利用反馈用于任何目的。
6.付费功能
My Radio 服务的某些功能（例如删除应用内广告）可能需要您付费才能使用。如果您选择购买这些功能，则表示您明确授权我们或我们的付款处理商通过您提供的付款方式收取相应费用。除下文明确规定外，所有费用均不可退还。所有费用和适用税费（如有）均以美元支付。
当您购买我们提供的任何附加功能时，该购买将收取一次性费用。一旦您购买这些功能并使用全部或部分功能，或在使用全部功能之前取消您的帐户，您将无权获得退款。根据本服务条款第 8 条的规定，我们保留随时以任何理由终止或暂停您使用 My Radio 服务的付费功能的权利，且不承担任何责任。如果我们根据本服务条款第 8 条的规定终止或暂停您的帐户，无论有无理由，您将无权获得您为这些功能向我们支付的任何费用的退款，除非销售条款另有规定。
7. 您使用My Radio服务时的义务。
My Radio 服务仅可用于合法和非商业目的。您同意遵守所有适用的当地、州、国家和外国法律、条约和法规，包括适用于您的业务和运营以及与您使用 My Radio 服务相关的隐私、安全和 PII 跨境转移的法律（包括但不限于遵守《通用数据保护法》（EU 2016/679）（“ GDPR ”））。如有需要，您应负责收集与收集、使用、维护和与 My Radio 共享的任何 PII 相关的可验证同意（根据 GDPR 定义），并拥有向 My Radio 提供此类数据所需的任何和所有权利，并确保正确获取任何此类数据。
此外，在不受限制的情况下，您同意在使用或访问网站或 My Radio 应用程序时不会执行以下任何操作：

上传、发布、通过电子邮件发送或以其他方式传输 (i) 您无权合法复制、传输和展示的任何用户提交内容（包括任何违反您对用户提交内容所承担的保密或信托义务的用户提交内容）；(ii) 您未获得用户提交内容中每个可识别人员的同意或许可，无法使用其姓名、声音、签名、照片或肖像（只要该人员与用户提交内容有关），并且需要此类同意或许可；或 (iii) 任何侵犯知识产权或侵犯任何第三方隐私权的用户提交内容（包括但不限于版权、商标、专利、商业秘密或其他知识产权，或道德权利或公开权）；
使用任何利用 My Radio 名称、商标、URL 或产品名称的元标签或其他隐藏文本或元数据；
上传、发布、通过电子邮件发送或以其他方式传输任何未经请求或未经授权的广告、宣传材料、垃圾邮件、垃圾信息、连锁信件、“传销计划”或任何其他形式的招揽；
伪造任何 TCP/IP 数据包头或任何帖子中的头信息的任何部分，或以任何方式使用 My Radio 服务发送更改的、欺骗性的或虚假的源识别信息；
通过 My Radio 服务上传、发布、通过电子邮件发送或以其他方式传输任何非法、淫秽、有害、威胁、骚扰、诽谤或仇恨的用户提交内容，或包含仇恨对象或符号、侵犯任何第三方隐私、包含裸体（包括但不限于任何色情、情色、儿童色情或儿童色情）、欺骗、威胁、辱骂、煽动非法行为、诽谤、中伤、粗俗或暴力或构成仇恨言论或 My Radio 认为令人反感的其他用户提交内容；
上传、发布、通过电子邮件发送或以其他方式传输任何包含隐藏代码或以其他方式秘密包含在用户提交内容的图像、音频或视频中的用户提交内容，且这些代码与用户提交内容的直接性、美学性无关；
干扰或破坏（或试图干扰或破坏）My Radio 服务、服务器或与 My Radio 服务相连的网络或 My Radio 提供商的技术交付系统上的任何网页，或违反任何与 My Radio 服务相连的网络的要求、程序、政策或规定；
试图探测、扫描或测试任何 My Radio 系统或网络的漏洞，或破坏、损害或规避保护 My Radio 服务的任何安全或身份验证措施；
试图破译、反编译、反汇编或逆向工程用于提供 My Radio 服务的任何软件；
尝试使用除 My Radio 或其他普遍可用的第三方网络浏览器（如 Microsoft Internet Explorer、Mozilla Firefox、Safari 或 Opera）提供的软件和/或搜索代理以外的任何引擎、软件、工具、代理、设备或机制访问、搜索或元搜索 My Radio 服务，包括但不限于向网站发送查询以确定网站或网页如何排名的任何软件。
未经其他 My Radio 用户的明确许可，收集或存储有关其他 My Radio 用户的个人数据；
通过借口或其他形式的社会工程手段冒充或歪曲您与任何个人或实体的关系，或以其他方式实施欺诈；
以本协议不允许的任何方式使用 My Radio 服务；
鼓励或指示任何其他个人做上述任何行为或违反本服务条款的任何条款。
8. 终止；取消。
如果您违反本服务条款，我们可能立即终止或暂停您对 My Radio 服务的访问，并从 My Radio 服务或我们的服务器中删除任何材料（包括用户提交内容）。尽管有上述规定，我们还保留随时以任何理由终止 My Radio 服务或您对服务的访问的权利。终止后，您理解并承认我们不再有义务提供 My Radio 服务。终止后，本服务条款授予您的所有许可和其他权利将立即终止。对于终止 My Radio 服务或终止您对 My Radio 服务的使用，My Radio 不对您或任何第三方承担责任。终止或暂停后，您将无法再访问您在 My Radio 服务上提交的或与您的帐户相关的任何信息（包括用户提交内容）。此外，My Radio 没有义务维护我们数据库中与您的帐户相关的任何信息，也没有义务将任何信息转发给您或任何第三方。
任何暂停、终止或取消都不会影响您根据本服务条款对 My Radio 承担的义务（包括但不限于所有权、赔偿和责任限制），这些义务的含义和上下文旨在在暂停、终止或取消后继续有效。
9. 修改My Radio服务或服务条款。
My Radio 保留随时自行决定修改、中止或终止 My Radio 服务或修改本服务条款的权利，恕不另行通知。如果您不接受修订的服务条款中任何修改后的条款和条件，您唯一的补救措施是停止使用 My Radio 服务。在 My Radio 进行任何此类修改后继续访问或使用 My Radio 服务，即表示您同意受修订的服务条款约束。
10. 免责声明。
My Radio 对 My Radio 服务上显示的信息或材料的准确性、内容、完整性、合法性、可靠性、可操作性或可用性不承担任何责任。My Radio 对任何信息或材料的删除、存储失败、错误交付或未及时交付不承担任何责任。My Radio 对通过 My Radio 服务下载或访问互联网上的任何信息或材料而造成的任何损害不承担任何责任。
MY RADIO 服务按“原样”提供，不提供任何担保。MY RADIO 在法律允许的最大范围内明确否认所有明示、暗示和法定担保，包括但不限于适销性、特定用途的适用性和不侵犯专有权利的担保。MY RADIO 否认有关 MY RADIO 服务的安全性、可靠性、及时性和性能的任何担保。MY RADIO 否认对通过 MY RADIO 服务获得的任何信息或建议的任何担保。 MY RADIO 对通过 MY RADIO 服务收到的或在 MY RADIO 服务上宣传的或通过 MY RADIO 提供的任何链接收到的服务或商品，以及通过 MY RADIO 服务中提供的任何链接收到的任何信息或建议不提供任何担保。
您理解并同意，您通过使用 MY RADIO 服务下载或以其他方式获取材料或数据完全出于您的判断并由您自行承担风险，并且对于因下载此类材料或数据而导致的您的计算机系统损坏或数据丢失，您将承担全部责任。
某些州或其他司法辖区不允许排除默示保证，因此上述排除条款可能不适用于您。您可能还拥有其他权利，但具体权利因州和司法辖区而异。
11.责任限制。
在任何情况下，MY RADIO 均不因用户使用、误用或依赖 MY RADIO 服务而导致与本协议或本协议主题相关的任何索赔而对任何用户承担责任，此类责任限制应适用于防止追偿直接、间接、偶然、后果性、特殊、惩戒性和惩罚性损害，无论此类索赔基于保证、合同、侵权（包括疏忽）或其他方式（即使 MY RADIO 已被告知此类损害的可能性）。无论损害是因使用、误用和依赖 MY RADIO 服务、无法使用 MY RADIO 服务，还是因 MY RADIO 服务中断、暂停或终止（包括由第三方造成的此类损害）引起的，此类责任限制均应适用。此限制还适用于因通过 MY RADIO 服务收到或在 MY RADIO 服务上宣传的其他服务或商品或通过 MY RADIO 服务中提供的任何链接收到的信息或建议而造成的损害。此限制还适用于（但不限于）采购替代商品或服务的费用、利润损失或数据损失。该限制还适用于 MY RADIO 服务的履行或不履行，或出现在 MY RADIO 上或以任何方式与 MY RADIO 链接或相关的任何信息或商品。即使任何有限救济的主要目的失败，该限制仍应在法律允许的最大范围内适用。
在任何情况下，MY RADIO 因这些服务条款或使用或无法使用 MY RADIO 服务或内容而产生的或与之相关的全部责任不得超过您为使用 MY RADIO 服务或内容而向 MY RADIO 支付的金额。
一些州或其他司法辖区不允许排除或限制偶发或间接损害的责任，因此上述限制和排除可能不适用于您。
在不限制前述条款的情况下，在任何情况下，My Radio 均不对因自然灾害、力量或超出其合理控制范围的原因直接或间接导致的任何延迟或未能履行义务承担责任，包括但不限于互联网故障、计算机设备故障、电信设备故障、其他设备故障、电力故障、罢工、劳资纠纷、骚乱、起义、内乱、劳动力或材料短缺、火灾、洪水、风暴、爆炸、天灾、战争、政府行为、国内或外国法院或法庭的命令、第三方的不履行义务、或供热、照明或空调的损失或波动。
12. 适用法律和审理地点选择。
这些条款及任何相关行动均受《中华人民共和国宪法》、《中华人民共和国民法典》管辖，而不考虑其法律冲突条款。
13.消费者纠纷解决。
第 13 条“消费者争议解决”中的以下条款仅适用于您是个人且将 My Radio 服务和 My Radio 内容用于个人用途且不代表法人实体的情况。
争议的解决。我们双方均同意，因本服务条款或其违反、终止、执行、解释或有效性或使用 My Radio 服务或 My Radio 内容而引起的或与之相关的任何争议或取消订阅（统称“争议”）将仅通过具有约束力的单独沟通解决，而不是通过集体、代表或合并程序解决。
用户在使用My Radio时遇到以下问题，可以选择取消订阅：(i)APP服务存在严重功能故障或无法正常使用；(ii) 乙方购买的APP内虚拟商品或服务与描述不符，且乙方未进行任何消费或使用；(iii) 用户在购买APP服务后的72小时内，由于个人原因需要取消服务，且该服务尚未被激活或使用；(iiii)每个用户对同一产品或服务的退款金额不得超过付款金额。超出限制的退款申请将不被支持。
14.DMCA/版权政策。
My Radio 尊重版权法，并希望我们的用户也尊重版权法。My Radio 的政策是，在适当情况下终止屡次侵犯或被认为屡次侵犯版权持有人权利的帐户持有人的帐户。
15. 其它规定。
本服务条款的中文版本是管辖您使用 My Radio 服务的版本，如果中文版本与翻译版本之间存在任何冲突，则以中文版本为准。
本服务条款构成双方就本服务条款主题达成的完整协议，并取代和替换所有之前或同期就该主题达成的书面或口头谅解或协议。对服务条款任何规定的任何放弃，只有以书面形式并由 My Radio 签署后才有效。
